摘要：当前,将信访活动中破坏信访秩序和社会公共场所秩序的行为纳入刑事评价已经常态化,成为信访法治化的重要标志,其中适用较多的罪名是寻衅滋事罪。就现有案例揭示而言,刑事评价信访寻衅滋事客观上也存在一些标准随意和模糊而导致的评价失度问题。信访行为被评价为寻衅滋事罪的扩张可能带来如下三种危害:冲击现有寻衅滋事刑事及行政规范体系的自洽性,背离社会进步趋势下信访矛盾稳中有降的规律,不利于社会主义民主观念的树立。构建公正合理的信访秩序,应在信访法治化目标中实现多元价值平衡,具体应在三重视野下权衡信访寻衅滋事罪的必要性和正当性,即寻求信访法制规范的体系化和正当化,准确把握社会效果与社会矛盾演变的规律,兼顾信访活动社会主义民主性与内部矛盾性。
At present,the behavior of disrupting the order of letters and visits and the order of social public places in the activities of letters and visits has been regularly incorporated into the criminal evaluation,which has become an important symbol of the rule of law in letters and visits.Among them,the most applicable charges are the Crime of Provoking.As far as the existing cases are concerned,there are objectively the error of evaluation caused by random and vague standards in criminal evaluation of the Crime of Provoking.The expansion of the crime of letters and visits,which is evaluated as the Crime of Provoking,may bring about the following three kinds ofharm:impacting the self-consistent nature of the existing criminal and administrative norms systems for the behaviour of Provoking,deviating from the law of steady and declining contradiction between letters and visits under the trend of social progress,and harming the concept of socialist democratic politics.To build a fair and democratic order for letters and visits,a balance of multiple values should be achieved in the goal of the rule of law for letters and visits.Specifically,the necessity and legitimacy of the Crime of Provoking should be weighed from a triple perspective,that is,to seek the systematization,legitimization and accuracy of the legal norms of letters and visits.Accurately grasp the law of the evolution of social effects and social contradictions,and take into account the democratic and internal contradictions of petition activities.
