摘要：在当下中国司法裁判的实践领域,人工智能的适用呈现外“热”内“冷”的境况。理论界多关注于人工智能与司法裁判融合的可能与限度,鲜有从具体融合路径展开的谱系性分析,未能提供实现两者深度融合的方法论指导。从人工智能的核心方法论与司法裁判的整体构造来看,两者深度融合的路径有内外之分。内在路径关注人工智能如何进入司法裁判的发现与证立层面,前者涉及人工智能为进行精确预测可能涉及的心理、社会等因素,后者涉及法律论证的逻辑建模。外在路径关注从更为宏观的角度达致人工智能与司法裁判深度融合的诉讼程序与司法制度,前者涉及完成诉讼辅助性事项、实现司法流程标准化管理等内容,后者涉及法官的角色定位、司法责任、司法行政管理等制度性问题。为实现审判体系与审判能力现代化,中国司法改革未来需要内外路径兼修、一体化推进两者的深度融合。
In the current practice field of judicial judgment in China, the application of artificial intelligence presents the situation of “hot” outside and “cold” inside.The theoretical community pay more attention to the possibility and limit of the integration of artificial intelligence and judicial judgmentd, but there are few genealogical analysis of the path of integration, failing to provide methodological guidance to realize the deep integration of the two.From viewpoint of the core methodology of artificial intelligence and the judicial judgment’s whole structure, there are two paths for the deep integration of artificial intelligence and judicial decision, namely the internal path and external path.The internal path concerns the context of discovery and the context of justification.The former involves the psychological or social factors which influence the artificial intelligence’s accurate prediction of judicial judgment, while the latter involves the logic modelling of legal argumentation.The external path concerns the judicial proceeding and the judicial system that may influence the deep integration of artificial intelligence and judicial judgment in a broader social context.The former involves the completion of judicial assistance and the realization of standardized management of judicial process and so on, while the latter involves the role of judge, judicial responsibility, judicial administration and so forth.In order to realize the modernization of the judicial system and judicial capacity, China’s judiciary reforms in the future must integrate internal and external paths and promote the whole integration of artificial intelligence and judicial judgment.
