摘要：最高人民法院公布的指导案例有多个在案情介绍、裁判要点、或裁判理由中表达出我国传统法精神及其当代价值诉求。这为规范传承传统法精神打开了一条当代司法路径。在这些疑难案件中,法官通过甄别选择合适的法律规范,将传统法精神注入其中直接适用或用以论证案件事实;或者运用传统法精神对法律规范的术语进行文义、限制、扩大、目的或体系等解释,使法律规范更加明确;当法律规范出现漏洞时,法官通过相关法律规范的类比,融入传统法精神,续造新的规范进行使用。法官综合运用规则技术、方法、思维、价值进行司法判断,解决了疑难案件的司法裁判,也将我国传统法精神及其当代价值的"情理"诉求与规范的"法"融合并规范适用。
The guiding cases released by the supreme people's court have expressed the spirit of China's traditional law and its contemporary value appeal in the introduction of the cases,the key points of the judgment,or the reasons for the judgment.This opens up a contemporary judicial path for carring on the spirit of traditional law in a normative way.In these difficult cases,the judges select appropriate legal norms through carefully selecting,and infuse the spirit of traditional law into them for direct application or to demonstrate the facts of the case.They also use the spirit of traditional law to interpret the terms of legal norms,such as the meaning,limitation,expansion,purpose or system,so as to make the legal norms more clear.Judges create new norms to use by analogy of relevant legal norms and integrating the spirit of traditional law when there are loopholes in legal norms.Judges make judicial judgments on difficult cases through comprehensive judgments of rules,techniques,methods,thoughts and values.At the same time,the traditional spirit of law and its contemporary value of "reason" appeal and "law" norms are integrated.
