摘要：社区停车位资源市场配置存在着很大的交易成本和市场失灵,法律界权和政府规制作为两种不同的制度安排在理论和实践上均试图取代或补充市场机制来配置资源。然而科斯主义介入和庇古主义介入本身又存在较大的法律界权福利损失和政府规制失灵,尤其是存在较高的法律界权的社会成本,且其对停车位资源配置效率并无较大提高。从发挥"市场在资源配置中起决定性作用"的角度来看,亟待用适当的政府规制手段和法律界权工具来分别解决上述问题,同时以适当方式介入到市场机制对停车位资源的配置中。若不考虑规制和界权的福利损失,市场机制的发挥将适得其反。
There is a great deal of cost and market failure in the allocation of parking spaces（ garage） in residential communities. As two different arrangements systems,legal rights and government regulation try to replace or supplement market allocation mechanism the resources in theory and in practice,especially the former. However,Coase intervention and Pigou intervention itself have the welfare loss of the legal right and the failure of government regulation,meanwhile the welfare loss and government failure is relatively large,and especially the higher legal right social costs. Therefore the efficiency of the parking spaces（ garage） resource allocation is not greatly improved.From the perspective of the market playing a decisive role in the allocation of resources,it is urgent to use government regulation and right tools to compensate for the welfare loss of legal rights and government failure. At the same time it should use a proper way to intervene in the market mechanism configuration of parking spaces（ garage） resources. If the welfare loss of legal power and government regulation are not considered,the result of market mechanism is just the contrary.
