摘要：虚拟货币是网络科技不断发展的产物,在虚拟货币相关犯罪频发的背景下,虚拟货币法律属性的界定就成为刑法适用的基础性问题。根据我国现行法律的规定,虚拟货币不具有货币地位。虚拟货币具有双重属性:计算机数据是其物理属性,财产是其本质属性。虚拟货币可以解释为我国刑法保护的“财产”。对于非法获取虚拟货币的行为,以计算机犯罪进行规制存在一定的局限性和不合理之处。根据财产属性和行为方式选择适用不同的财产犯罪罪名,既符合非法获取虚拟货币行为的本质,也符合罪责刑相适应原则,还能妥善保护被害人的财产权益。在计算非法获取虚拟货币犯罪的犯罪数额时,以实施犯罪行为当天的交易均价为依据更为合适。
Virtual currency is the product of the continuous development of network science and technology.Under the background of frequent crimes related to virtual currency,the definition of its legal attribute becomes the basic problem of the application of criminal law.According to the current law of our country,virtual currency has no monetary status.Virtual currency has dual attributes,in which computer data is its physical attribute and property is its essential attribute.Virtual currency can be interpreted as"property"protected by China’s criminal law.There are some limitations and irrationalities in regulating the illegal acquisition of virtual currency by computer crime.We should choose different property crime charges according to their property attributes and behavior patterns,which not only conforms to the nature of the behavior,but also conforms to the principle of adapting crime to punishment,and can properly protect the rights and interests of victims.When calculating the crime amount of illegally obtaining virtual currency,it should be based on the average transaction price on the day of the crime.
