摘要：宽严相济作为我国刑事法律司法适用的一项基本政策,其不仅为社区矫正适用提供了主客观要素的指引,也为社区矫正的适用范围提供依据,二者之间存在抽象与具体、宏观与微观的逻辑关系。深入贯彻宽严相济刑事政策在社区矫正适用过程中的功能与价值,能够保障公民的基本权利,推动行刑社会化,节约司法成本,推进刑事执行制度改革,为国家治理体系和治理能力现代化提供多元路径。
As a basic policy of criminal law judicial application, the criminal policy of temper justice with mercy provide not only the guidance of subjective and objective elements for the application of community correction, but also the basis for the scope of application of community correction. There is a logical relationship between them, which is abstract and concrete, macro and micro. The in-depth implementation of the function and value of the criminal policy of temper justice with mercy in the process of community correction can guarantee the basic rights of citizens, promote the socialization of execution of punishment, save judicial costs, promote the reform of criminal execution system, and provide multiple paths for the modernization of national governance system and governance capacity.
