摘要：我国1997年刑法典规定了单位犯罪之后,基本上确立了公司犯罪的双罚制原则。文章在分析公司犯罪双罚制原则理论根据的基础上,对双罚制原则本身利弊进行了客观评价,结合我国公司犯罪双罚制原则的现状,在吸收借鉴国外先进立法经验的基础上,提出了构建独立完整的公司犯罪刑罚体系的具体设想。
Dual punishment system has been established by the Criminal Code 1997 in China. Based on the analysis of its theoretical foundation, the advantages and disadvantages have been evaluated in this paper. Combining with the current situation of China and foreign legislation experience, it is proposed to set up independent penalty system of corporation crime.
