摘要：司法和谐是当今较为流行的司法话题,但和谐是否是司法的目标和特性,它和司法公正是何关系,需要学者进一步澄清。如果说司法公正是司法体系内部的目标,那么,司法和谐则为附加于司法的外部任务,二者的品性特征并不相同。司法和谐应当也只能在程序意义上展开,以实现中国国情下司法和政治目标的正确衔接。
Justice harmony is very popular. These prlblems that whether the harmony is the goal of justice and what is the relationship between them must be clarification by scholars. If impartial judicature is the internal goal of the justice, harmony is the external task of the justice for political. Neither are the same character. In practice, the judicial harmony is contrary to judicial law and justice harmony should be carried out in procedures in order to＇achieve the correct convergence of the justice and politics under China＇s national conditions.
