摘要：获取孤儿作品著作权是数字图书馆建设的难题。查找成本既是维持著作权保护机制正常运作之所需,又是获取孤儿作品著作权必须付出的额外成本。在坚持使用者独立查找原则的基础上降低查找成本成为孤儿作品制度设计的关键,各国因此形成不同的查找模式。美国模式、欧盟模式、加拿大模式和英国模式各具特色,凸显了降低查找成本的努力。《中华人民共和国著作权法(修订草案送审稿)》第51条就孤儿作品数字化问题选择了公共机构集中审查和许可的模式,这是高成本的制度选择,不利于数字图书馆建设,应借鉴各种模式中的有益成分予以改造。
The copyright of orphan works is of great difficulty for digital library construction. Diligent search cost is not only what the copyright protection needs to maintain its mechanism, hut also an extra cost for the use of orphan works. On the basis of independent search, how to reduce the search cost becomes the key issue for system design of orphan works. There are different search systems in different countries. United States, European Union, Canada and Britain have their own search systems that respectively highlight their efforts to reduce the search costs to a variable extent. Article 51 of the third revision draft of copyright law of China chooses the central censorship and licensing in public institutions on the digitalization of orphan works, which is a costly system and is against the digital library construction. Therefore, valuable lessons should be drawn from other systems for the revision of this article.
