摘要：除了独立抽象性之外,单据性是独立担保的另一重要特征。根据付款条件的差异,独立担保项下的单据可分为付款请求书、违约声明、第三方文件、法院判决或仲裁裁决等类型。在各国法律上,独立担保领域普遍遵循单据严格相符的原则,要求单据与付款条件、单据与单据之间表面相符。由于独立担保项下的单据缺乏标准化,各国司法实践中严格相符原则的尺度宽严不一。我国法院应当在严格相符原则的基础上,坚持单据的种类、类型和内容上的严格标准,以维护独立担保的确定性和效率性。
Besides the independent abstractness,the documentary nature is another feature of independent guarantees. Based on different payment conditions,the independent guarantees can be divided into different categories such as claims for payments,statement of default,documents from the third party,court judgments or arbitration awards. In various legal systems,the independent guarantees shall conform to the doctrine of strict compliance of documents that is the document should be complied with terms of payments,and documents should be complied with each other in form. However,in lack of standard forms of documents,the criteria of strictness doctrine vary in practice in different countries. Courts in our country should adhere to the doctrine of strict compliance by applying strict standards on types,categories and content of documents so as to ensure the certainty and efficiency of independent guarantees.
