摘要：美国《谢尔曼反托拉斯法》自1890年颁布以来已经过了百年的发展与演变。在这个过程中,美国法院运用经济学竞争理论对该法的实施作出了卓越的贡献,他们为反托拉斯法框架指明的方向,使得该法成为随着社会经济发展的需要而能够适时地回应企业、社会和消费者发展的需要的"经济宪法"。
the Sherman Antitrust Law, issued in 1890 by U. S. A, has devolped and pro- gressed for about one handrend years. In this process, the Courts in U. S. A give the outsantding contribution to the enfocement of this law by economic competition theory. The direction to which they pointed makes it become the ＂Economic Consititution＂, which responds to requirements of the enterprises, society and customers according to requirements of the development of society e- conomy.
