摘要：近年来,因精神病人暴力行为导致伤害的事件时有发生。原有的针对精神病人的行政化强制决定缺乏必要的程序限制,容易导致侵犯人权现象的发生。2012年修订的《刑事诉讼法》增设"依法不负刑事责任的精神病人的强制医疗程序",将精神病人强制医疗行为纳入程序化、法制化轨道,最高人民法院也公布了相应的指导案例。尽管如此,现行精神病人强制医疗程序在程序启动、司法鉴定、具体执行等方面仍然存在问题,需要进一步完善。
In recent years,it is common to see some incidents of violence caused by violent acts of the mental patient. The original decision of administrative repression of mental patients is short of necessary procedural restrictions,tending to cause violations of human rights. In 2012,the revised criminal procedure added mandatory medical procedures for mental patients. The supreme court has released and published in the proceedings of the supreme court,which put psychiatric patients in the process of institutionalized medical behavior. Despite this,something is wrong with the current criminal compulsory medical procedure of mental patient in terms of procedural activation,judicial identification,specific implementation,etc. It needs to be improved further.
