摘要：自然人违约责任能力本质上是自然人承担违约责任的资格,与自然人的权利能力及行为能力无直接关系,具有独立性。我国未来民法典合同编不应漠视自然人违约责任能力制度的构建,尤其不应漠视行为能力欠缺的自然人违约责任能力制度的构建。根据年龄和认知辨识能力标准,认知辨识能力正常的成年人具有完全违约责任能力,独立承担违约责任;行为能力欠缺的自然人具有不完全违约责任能力,其独立订立的有效合同,或者由其法定代理人代理及追认的有效合同,因其违约行为给合同相对人造成损害,应当以其自己的财产承担违约责任,其法定代理人应当承担补充责任。在上述理论构想的基础上,构建自然人的违约责任能力制度。
The capability of natural persons'responsibility for breach of contract is a qualification that natural persons bear responsibility for breach of contract,independently having no direct relationship with capacity of natural persons for civil rights and capacity of natural persons for civil conduct.The system construction of capability of natural persons'responsibility for breach of contract,specially,the system construction of capability of responsibility for breach of contract of natural persons with incomplete capacity for civil conduct should not be ignored in future China's civil code.Based on standard of age and cognitive ability,adults with normal cognitive ability have the complete capability of responsibility for breach of contract;natural persons with incomplete capacity for civil conduct have incomplete capability of responsibility for breach of contract.They conclude valid contract by themselves or their legal agent,or recognized by legal agent;they bear the responsibility for breach of contract within the scope of their own property;when they break contract to damage relative party of contract,their legal agents bear the supplementary responsibility.On the basis of the above theoretical conception,the system of capability of natural persons'responsibility for breach of contract is constructed.
