摘要：周刚志、李秋容等同志分别用交叉学科研究方法对数字时代重构图书馆著作权(新型信息网络传播权/著作权例外)进行了探索。研究发现两文的内在逻辑是《公共图书馆法》和《著作权法》《信息网络传播权保护条例》等知识产权法规间存在冲突,但《公共图书馆法》和知识产权法规间是衔接统一的,并不存在冲突,其论断同时违背《公共图书馆法》和知识产权法的基本规则和理论。研究图书馆著作权等知识产权问题,应以《公共图书馆法》确立的遵循论为基础,推动公共图书馆事业健康发展。
Comrade Zhou Gangzhi, Li Qiurong and others used interdisciplinary research methods to explore the reconstruction of library copyright in the digital age(new information network communication rights/copyright exception).It is found that the internal logic of the two articles is that there is a conflict between the Public Libraries Law and the Regulation on the Protection of the Right to Communicate Works to the Public over Information Networks.However, Public Libraries Law and the intellectual property law are connected and unified, and there is no conflict.This inference violates the basic rules and theories of Public Libraries Law and the intellectual property law at the same time.Research on library copyright issues should be based on the compliance theory established by Public Libraries Law to promote the healthy development of public libraries.
