摘要：中国学界通常对富勒自然法思想的理解是片面、不完整的。富勒其实先后提出两种类型的自然法理论:尤那米克斯和程序自然法理论。两者的相同之处在于,其关注的核心都是手段、形式。两者的不同之处在于,尤那米克斯关注良善秩序与可行的社会安排,寻求"社会秩序的自然法",而程序自然法理论则集中关注立法、司法过程中隐含的"内在道德"。由此可见,富勒的自然法理论并非程序自然法这个标签能够完全涵盖。富勒原本的理论雄心在于,发现所有社会秩序形式背后的"自然法则",完成"使人类行为服从规则之治的事业"。
As to the natural law theory of Fuller,the common sense of Chinese academics’ is one-sided and incomplete.Fuller actually successively put forwards two kinds of natural law theories,namely the Eunomics and the procedural natural law theory.Means and processes constitute the core issue of both the two natural law theories.Eunomics focuses on good order and workable social arrangements,so to seek"the natural law of social order".Procedural natural law theory focuses on"the internal morality"implied in the legislative progress and adjudicative process.It follows that Fuller’s theory of natural law is not exhausted by the label of procedural natural law.Fuller’s original theoretical ambition is to discover the natural laws behind all forms of social order and accomplish"the enterprise of subjecting human conduct to the governance of rules".
