摘要：我国《农村土地承包法》确立的土地经营权流转制度有利于盘活土地资产并增加农民收益,但缺乏保障农业绿色发展的环境规制制度。土地流转中的环境问题是流转经营主体行使民事权利、追求经济利益过程中带来的一种不利后果,需要秩序行政的环境规制加以防范。但由于现行法律规制理念、制度、体制、责任的局限性,难以防范环境问题。《农村土地承包法》应构建新型的土地流转环境规制制度,实现既有土地产权制度与环境规制制度的有机统一,树立绿色发展理念、完善规制制度、创新管理体制、创设责任条款。
The transfer system of land management rights established in the Rural Land Contract Law is beneficial to revitalizing land assets and increasing farmers’ income,but lacks the environmental regulation system to guarantee the green development of agriculture. The environmental problem in land circulation is a disadvantageous consequence in the process of exercising civil rights and pursuing economic interests,which needs to be prevented by environmental regulation of orderly administration. However,due to the limitations of the current legal concept,system,system and responsibility,it is difficult to prevent the occurrence of environmental problems. The Rural Land Contracting Law should construct a new type of environmental regulation system for land circulation,and realize the organic unification of the existing land property rights system and environmental regulation system: establishing the concept of green development,innovating management system,perfecting regulation system and creating responsibility clauses.
