摘要：自治条例和单行条例是我国民族自治地方自治机关行使自治权的重要体现。它是当代中国法的渊源和法的主要形式之一,其在法律体系中的层级地位仅次于宪法和《立法法》第六十六条第二款规定的其不得违背的法律法规的基本原则与有关规定。它与其他规范性文件的冲突适用,应严格依照《立法法》的相关规定。变通和补充法律规定属于自治条例和单行条例的范畴,法律变通规定应该包括补充法律规定,民族自治地方的法律变通权属于职权立法。
Autonomous regulations and separate regulations are important manifestation of ethnic autonomous areas to exercise autonomy in china. It is one of the legal sources and main forms of modern Chinese law. Its position in the legal hierarchy is lower than the constitution and the basic principles and the relevant provisions of laws that these regulations shall not violate by the second paragraph of Article 66 of the ＂Legislation Law＂. When it conflicts with other regulatory documents, that should be strictly in accordance with the relevant provi- sions of the ＂Legislation Law＂. The supplementary provisions of the law and the flexible provisions of the law belong to the autonomous regulations and separate regulations＇ range. The flexible provisions of the law should include the supplementary provisions. The right of law＇ s accommodation in the national autonomous local areas belongs to the authority legislation.
