摘要：近年来,环保部发起的环保约谈虽然对环境行政体制、政治生态、经济结构等产生了一定影响,但尚未从根本上触及经济增长与环境保护之间的关系,很难说能长期推动环境法功能的有效发挥。出现这种结果的原因表面上在于政府部门重经济增长、轻环境监管,根本原因在于地方政府经济优先的发展思路催生了环境执法部门"泛经济理性"的执法理念。该执法理念扭曲了环境法的立法原意,也在一定程度上反映出环境立法需要进行价值理念转型。生态优先作为生态文明时代的先进理念,是对工业文明时代经济优先理念的超越,应当成为现代环境法治的遵循。以生态优先理念完善环境法律制度,就要建立健全生态法律体系、生态法律制度和生态环境管理体制。
In recent years, the Ministry of Environmental Protection has launched the ＂environmental questioning＂ policy that al-though has a certain impact on the environmental administrative system, political ecology and economic structure, it doesn＇t fundamen-tally adjust the relationship between economic growth and environmental protection, and it＇s hardly to tell what effect it will have to pro-mote efficiency of the environmental law for a long time. Appear this kind of situation, the reasons on the surface is that the governmentdepartment attaches importance to the economic growth and environmental monitoring, while the fundamental reason is that local gov-ernment＇s idea of economic priority development has given rise to the philosophy of ＂overflow economic rationality＂ implemented by theauthority of environmental law enforcement The law enforcement concept distorted the environmental law＇s original intent, but to a cer-tain extent, suggested transformation of the value concept of environmental legislation. Ecological priority concept is the advanced con-cept of ecological civilization era, which beyond economic priority concept in the industrial civilization era, and ought to become one ofthe follow environmental laws on value concept. The concept is the economic concept of transcendence embodied in the legal system de-sign, and it aims to improve the ecological legal system, legal institutions and environment management System.
