摘要：没收资产国际分享制度是美国国际刑事司法协助制度体系中一项极具特色的制度,其对于美国与其他国家开展国际刑事司法合作产生了积极的推动作用。我国应当参考和借鉴美国的没收资产国际分享制度,构建我国的没收资产国际分享制度,并在与美国开展没收资产国际分享时使用合理策略,以维护我国的国家利益。
The international sharing of forfeited criminal assets is an important mechanism of the mutual legal assistant system in criminal matters of the United States of America,which has a positive effect on the mutual legal assistance between the United States and other countries.We should learn from this mechanism of the United States to construct our own mechanism of international sharing of forfeited criminal assets,and take rational strategy when sharing forfeited criminal assets with the United States to protect our national interests.
