摘要：民工子弟学校是中国市场经济的产物,承担了部分政府无法承担的基础教育责任,避免了大批民工子弟沦为文盲。然而由于立法的不完善导致政府强行关闭部分不达标的黑户民工子弟学校,影响到学生受教育权的实现。违宪审查制度可以规制立法的缺陷,比例原则则可以约束政府的过分行为。
The schools for civilian workers' children are the product of Chinese market economy,which take on part of basic education that government can't pay for and prevent a large number of civilian workers' children froubeing illiteracy.However,the government enforces to close down some schools which can't conform to the requirement,and all this affects the realization of their educational fights.The system that examines whether laws violate constitution may regulate the defects of laws,and the principle of proportion may restrict the excessive behaviors of the government.
