摘要：刑法分则规范所存在的立法缺陷已引起了理论界的诸多评判,但现有评判却缺乏应有的有因性分析。其实,透视立法缺陷存在的有因性,是修补这些缺陷不可或缺的基础性工作。而对刑法分则规范现有缺陷的矫正,必须遵循一定的具体规则,即合理性规则、确定性规则、协调性规则和适度模糊规则。同时在研究方法上,也应采用实证分析的方式,从而得到比单纯理论研究更为丰富的立法支点。
The legislative defects existing in the norms of the specific provisions of criminal law have led to much judgment in the circle of theorists. But the current judgment lacks due analysis of cause. In fact, seeing through the cause of in the legislative defects in the essentially basic work to repair these defects, we must follow certain concrete ride, namely ride of reasonableness determinative stipulation, rule of coordination and due fuzzy ride, to correct the current defects of the norms of the specific provisions of criminal law. At the same time in the research methods, we should adopt the way of positive analysis so that we can get the more richly legislative fulcrum than from simple theoretical research.
