摘要：生态文明建设与法治无论在内容层面还是在精神层面均存在契合,行政约谈制度的发展推动并丰富了依法行政的治国理念。在生态法治领域,环境行政执法约谈日益受到各级环保行政执法部门的青睐而成为普遍采用的环保执法方式,其柔性执法的特征符合构建法治政府、服务型政府等现代执政理念以及建设生态文明的基本精神。但这一制度在获得积极发展的同时还存在着若干制度缺陷。为进一步实现制度绩效,我们应从不断完善其法律依据、准确定位功能、扩展启动条件、创新内容、强化制度保障等方面完善这一新型的制度。
The construction of ecological civilization is in unison with the rule of law both in the content and in the spirit.The development of the administrative appointment system has promoted and enriched the theory of administrative law.In the field of ecological rule of law.The environmental administrative enforcement of law interview has been increasingly favored to environmental administrative law enforcement departments at all levels of environmental protection and become widely used environmental protection law enforcement mode.Its characteristics of its flexible law enforcement is in line with the basic spirit of building a law-based government,service-oriented government,other modern ruling idea and the construction of ecological civilization.But this system also has some systematic deficiencies in the course of positive development.For the further implementation of the system performance,we should continue to perfect its legal basis,accurately position function,extend startup condition,innovate upon content,strengthen the system security etc.
