摘要：社区矫正作为一种非监禁刑罚措施,有其存在的理论依据与法律依据。行为人的社会危害性、犯罪情节与人身危险性是社区矫正风险评估的理论依据,社会危害性是前提依据,犯罪情节是客观依据,人身危险性是主观依据,三者是有机统一的整体。社区矫正风险评估的法律依据包括国际法和国内法。国际法是世界刑罚改革的发展趋势,具有借鉴意义;国内法是实施风险评估的直接依据。社区矫正风险评估既体现了刑法目的与刑罚目的的一致性,也反映了社区矫正是我国刑罚改革尊重和保障人权的价值取向。
The community correction,as a non-imprisonment penalty measure,has its theoretical and legal basis.The social harmfulness,crime circumstances and personal dangerous of the behavior are the theoretical basis of the risk assessment system of the community correction,that social harmfulness is the essential basis for risk assessment of the community correction,the circumstances of the crime is the objective basis,and the personal dangerous is the subjective basis,which of the above are considered of the organic unity of the whole. The legal basis of the community correction risk assessment consists of international law and domestic law,International law is the development trend of the world penalty reform,which has its reference value. And the domestic law is the direct basis for the implementation of risk assessment. The risk assessment of the community correction not only incarnates the consistency of criminal law and punishment,but also gives expression to the value orientation of China＇s penalty reform,which is to respect and protect human rights.
