摘要：审判中心制度的构建定位于诉讼制度的改革与完善,相关举措是在保持现行司法体制不变情形下展开的,这只是一种技术路径的改革。技术路径的改革由于缺乏系统环境的支持,往往难以收到预期效果,实践中的困难正印证了这一点。审判中心的本质是确立审判权威,而审判权威的树立仅靠审判环节难以实现,需要放在更大的司法体制系统视野下,在三机关职权关系上做出调整,即确立法院中心、树立法院权威,这是审判中心乃至审判权威得以实现的外在基础。未来审判中心或者审判权威的真正建立需要在对相关原则、制度加以修改完善基础上,围绕系统和技术双重路径立体化、复合式展开,方能真正实现审判中心。
The construction of the trial center system is to be located on the reform and perfection of the litigation system,and the related measures are carried out under the condition of maintaining the current judicial system.It is a reform of the technical path.The reform of the technical path is difficult to produce the expected effect due to the constraints of space and related systems.These concerns have been confirming from obstacles in practice.The essence of the trial center is to establish the authority of the trial,and the establishment of the authority of the trial is difficult to achieve only by the trial center.It should be put into a more larger vision of judicial system to establish the court center among the three organs,by laying the objection foundation of trial center and authority of the trial.For this reason,the real establishment of the trial center or the authority of the trial requires a compound approach by means of two paths of systems and technologies,and an opportunity to revise and improve the relevant principles and systems to achieve a true trial center.
