摘要：改革开放以来，我国的刑事立法有了长足的发展，但随着改革的深入和司法实践的检验，刑事立法的不足和缺陷也日益显露出来：1．刑法规范的完备性不足，仍然存有法律的盲区。2．法律规范的协调性不足，有些条款自相矛盾。3．刑法规范的确定性不足，刑法规范之间界限模糊，有些概念没有界定，概念术语使用混乱。4．刑法规范的简约性不足，有些条款重复，应当合并的罪名没有合并。5．刑事立法与刑法理论存在矛盾和冲突。6．有些地方表现出理性的欠缺。透视并力进立法缺陷是每个法律工作者义不容辞的职责。
China's criminal law has been greatly lmproved since the reform and opening-up, but with the deepeing of reform and judicial practice, defects and failings in the criminal law become obvious: 1 there still exist areas that are not covered by the law; 2 some items are contradictory to one another; 3 some concepts are not clearly and stricdy defined, causing ambiguity and confusion; 4 some statements are redundant, not concise; 5 criminal legislation and criminal theory do not merge harmoniously; and 6 reasoning in some parts is not strong.
