摘要：社会和经济的发展导致作品创作的智力投资者和财力投资者分离,著作权的归属成为双方争夺的焦点,我国的委托作品、职务作品和法人作品制度对此进行了规定。但是各类作品分类标准模糊、要件选择随意以及权利分配原则矛盾、分配规则粗疏,导致弊病丛生。本文从两种著作权观念的反思出发,结合我国的立法旨趣,针对非独立创作的实际情况,对我国著作权法规定的三类作品提出全面的整合意见。
Social and economic developments led to the participation of financial investors in the creation of works. As a result, the financial investors demand a share of the copyright. The Copyright Law pro- vides the rules of copyright ownership for commissioned works, post works and corporate works. Howev- er, there are a lot of question in the provisions such as vague classification standards, random selection of elements of the concept, contradictory and simple distribution rights. In this paper, the authors reflect on two different concepts of copyright law and China＇s legislative purpose, and then put forward some suggestions of reconstruction according to the non--independent situation of writing.
