摘要：根据有关数据进行分析,“醉酒”型危险驾驶罪入罪十年来的数量整体上属于先降后升的态势,醉酒驾驶案件近几年来超越盗窃罪,高居全国刑事案件之首。面对有关学者关于取消“醉酒”型危险驾驶罪的建议,文章认为醉酒驾驶案件总量过大的原因是“入罪”缺乏明确统一的量刑标准和“出罪”路径受阻。国家应依法适用认罪认罚从宽制度,落实宽严相济的刑事政策;立法层面应适度提高定罪门槛,对情节严重行为保持严惩态势。
According to the analysis of the data of the courts and procuratorates in recent ten years,the number of "drunken" dangerous driving crimes in the past ten years has generally decreased first and then increased.Even drunken driving cases have surpassed theft in recent years,ranking first in the country’s criminal cases.Faced with the proposal to abolish the "drunken" dangerous,this paper believes that the reason for the excessive total amount lies in the joint effect of the improper expansion of the "guilty" standard and the obstruction of the "guilty" path,and the lack of clear and unified sentencing standards,resulting in the uneven sentencing between different places.We should raise the conviction threshold at the legislative level,maintain the situation of severe punishment for serious acts,and implement the criminal policy of tempering justice with mercy.
