摘要：法治与德治的结合主要体现在法律至善和法律人至善两个方面。对司法职业而言,司法者至善其实就是要求司法者树立一种司法人格,借助司法人格来搭建德治与法治结合、德治完善法治的桥梁。在中国从初级阶段的法治迈向高级阶段法治进程中,司法人格的全面提升属于其不可或缺的前提之一,即司法人格作为整个社会法治人格的引领力量必须先行并自我设限于更高的使命和要求,才能和良法一起实现法治与德治的完美结合。
The combination between the rule of law and the rule of virtue is mainly embodied in two aspects,namely the perfection of the law itself and the perfection of the law practitioners. For the judicial profession,the perfection of the law practitioners requires justiciary to establish judicial personality, with which to bridgebetween the rule of law and the rule of virtue. In China’s transition from the primary stage of the rule of lawto the advanced stage of the rule of law, the comprehensive promotion of judicial personality is one of itsindispensible prerequisites. That is, the judicial personality as the leading force of the rule of law of the wholesociety must be first and self-limited to a higher mission and requirement in order to realize the perfectcombination of the rule of law and the rule of virtue with good law.
