摘要：农村集体经济组织成员参与集体经济组织治理是保障农民在集体经济组织中权益、促进集体经济组织规范运行的关键。我国立法并未系统规定集体经济组织成员参与治理的权利,实证调研也发现集体经济组织成员缺乏参与治理的动力与制度性保障的途径。未来我国应制定集体经济组织单行法,明确规定成员的选举权、被选举权、表决权、监督建议和质询权、知情权、派生诉权以及召集和主持成员大会的权利等。
Organizing members to be involved in rural collective economic administration is a key to protect the rights and interests of farmers and improve the regulations in collective economic organization.In our legislative system,the rights of organizational members to be involved in administration are not systematically specified;from empirical research,we also find out that there’s lack of motivation and systematic guarantee for those members.In the future,China should establish collective economic organizational law,in which members’rights of election,to be elected,to vote,to supervise and advice,of inquiry,to know,derivative rights of action and gathering for member meeting,etc.
