摘要：2018年3月2日,两高司法解释正式确立了刑事附带民事公益诉讼制度。通过对刑事附带民事公益诉讼的实证分析,发现刑事附带民事公益诉讼在理论基础、制度设计上存在一些尚未解决的问题。刑事附带民事公益诉讼是刑事附带民事诉讼和民事公益诉讼两种诉讼制度的结合,《刑事诉讼法》中有关附带民事诉讼的规定应当成为法院判决刑事附带民事公益诉讼案件的法律依据。检察机关在附带民事公益诉讼中的地位应当作为原告人,检察机关不服人民法院刑事附带民事公益诉讼案件第一审判决裁定的,应当向上一级人民法院提出上诉而非抗诉。
The newly interpretations from Supreme People’s Court and Supreme People’s Procuratorate formally established the criminal supplementary civil public interest litigation system in China on March 2,2018.Through the empirical analysis of criminal supplementary civil public interest litigation,it is figured out that there are some unsolved problem within its theoretical basis and structure designs.The criminal supplementary civil public interest litigation is a combination of the criminal supplementary civil litigation and the civil public interest litigation.Provisions in Chinese current Criminal Procedure Law towards supplementary civil litigation should be the legal basis when the court judge criminal supplementary civil public interest litigation cases.The procuratorial organ in the criminal supplementary civil public interest litigations shall be regarded as a prosecutor,and when the procuratorial organ can not agree with the first-instance judgment declared by the people’s court,it shall appeal to the next higher people’s court instead of following protesting procedure.
