摘要：教育应急权是国家应急权的组成部分,具有限制私权维护公益性、权力高度集中性、高度的自由裁量性、程序简化性。在教育领域发生突发事件时,教育应急权的行使限制了学生的受教育权。部分限制措施属于维护公益所必需,是受教育权的容忍范围。但一些限制则超出了教育应急权的正常裁量范围,对学生受教育权产生了过度侵害。要防止教育应急权过度限制受教育基本权利,需要对该权力进行规范。在宪法层面,宪法要进一步明确对公民受教育基本权利的限制与保障;宪法监督教育应急权要实效化。在行政法层面,教育应急立法要实现规范化与体系化;教育应急执法要具备合理性与及时性。
The emergency right on education is a component of national emergency right,which has the characteristics of restricting private right to maintain public welfare,high concentration of power,high discretion,and simplified procedure.When an emergency occurs in the field of education,the emergency right on education could be exercised,which may restrict the right of students to receive education.Some restrictions are necessary to protect the public interest and can be tolerated by the students’right of receiving education.However,some restrictions go beyond the normal discretion of the emergency right on education,and cause the excessive infringement on students’right of receiving education.In order to prevent the emergency right on education from excessively restricting the basic right of receiving education,it is necessary to regulate the right.At the level of constitution,the constitution should further clarify the restriction and guarantee of citizens’basic right of receiving education;and the supervision of the constitution on the emergency right on education should be effective.At the level of administrative law,education emergency legislation should be standardized and systematized;and the enforcement of education emergency law should be reasonable and timely.
