摘要：认罪认罚从宽是与当代中国社会治理进步遥相呼应的中国特色的新型诉讼制度,但在实践过程中,也出现了一些理解和操作上的混乱。譬如,针对被告人反悔后上诉问题,用抗诉遏制上诉,用抗诉加刑惩罚“失信”被告人,甚至对因之发回重审的案件也要求加刑处罚。这些做法其实是把认罪认罚具结书契约化看待的结果,因而对不诚信或违反契约的行为进行契约“惩罚”,而实质上认罪认罚从宽只是一种司法宽容,以契约“惩罚”被告人反悔上诉的做法缺乏合理性。以司法宽容来认识认罪认罚从宽,有助于对被告人反悔问题建立理性化认识,避免将其陷入浅层意义上的公权力“报复”,使其作为正义实现的一种特殊途径被真正贯彻好。
The leniency with pleaded guilty is a new type of litigation system with Chinese characteristics,which is in accordance with the progress of social governance in contemporary China,however,there have also been some confusions in understanding and operation.For example,in response to the defendant’s appeal from regret,the protest was used to curb the appeal,the protest was used to punish the "dishonest" defendant,and even the case of a retrial for which the defendant was sent back to trial required additional punishment.In fact,these practices are the result of the contractualization treatment of the leniency with pleaded guilty,and the punishment of dishonesty or breach of contract is imposed.In essence,the leniency with pleaded guilty is only a kind of judicial tolerance,so the "punishment" of the defendant’s appeal after repentance is unreasonable-Recognizing the essence of judicial tolerance will help to have a more rational understanding of the defendant’s regret,so as to avoid the system of lenient punishment into a shallow sense of public power "revenge",so that it can be truly implemented as a new way to achieve justice.
