摘要:河南省城乡统筹建设用地市场建立中存在的突出问题表现在:集体土地入市范围有限、集体土地入市依据不足、集体经营性建设用地入市与征地制度改革的关系尚未厘清、河南“地票”和集体建设用地建设租赁住房政策的探索与其他制度的衔接不足。上述问题存在的体制机制原因为:集体土地产权制度不明晰,产权体系良好运行机制尚待发掘,土地用途管制下不同政策探索中的内生矛盾一直存在,地方政府对建设城乡统一建设用地市场的激励与约束机制不健全,政策内、政策间的协同性耦合性尚有较大的提升空间。政府应该摸清集体土地入市土地情况并探索确立入市主体及利益分配机制,建立健全集体经营性入市的规划和用途管制前提,完善征地制度为集体土地入市奠定基础。政府作为政策推动者和利益主体的角色不能忽视。
The prominent problems in the establishment of urban and rural construction land market in Henan Province are as follows:limited scope of collective land entering the market,insufficient basis for collective land entering the market,unclear relationship between collective construction land entering the market and land requisition system reform,insufficient connection between the exploration of land ticket and rental housing policy of collective construction land and other systems.The reasons for the above problems are as follows:the collective land property rights system is not clear,the good operation mechanism of the property rights system remains to be explored,the endogenous contradiction between different policy exploration under land use control has always existed,the incentive and restraint mechanism of local governments for the construction of a unified urban and rural construction land market is not perfect,and the synergy and coupling between policies has been greatly improved.Space.From the perspective of government policy,the future should be as follows:to find out the situation of collective land entering the market,to explore and establish the main body and benefit distribution mechanism,to establish and improve the premise of planning and use control for collective management entering the market,to improve the land expropriation system to lay the foundation for collective land entering the market,and the role of the government as a policy promoter and interest subject cannot be ignored.
