摘要:检察机关转隶改革后,环境公益保护的中国检察方案正在逐渐形成。然而,实践中依然存在检察环境公益诉讼定位不够明确,生态环境与资源保护的检察监督范围较窄,维护整体环境公共利益的执法效果不强,参与环境治理的机制不健全等问题。新时期,我国环境法治在中国共产党的领导和推进下,生态优先、绿色发展成为社会经济发展的主旋律,地方政府环境保护职责日益强化,并逐步形成了综合生态管理理念和模式。检察环境公益诉讼应当契合新时期中国环境法治发展进程,通过检察监督夯实各级政府的环境行政责任,强化对公共环境利益从过程到结果的全方位监督,坚持督促监督与履职协调有机结合。新时期检察环境公益诉讼优化进路包括:明确规范检察环境公益诉讼受理范围,优化环境行政检察监督实现方式,完善检察监督权与行政权的协同互动机制。
After the procuratorial organs were transferred to the reform, they gradually formed a procedural function with Chinese characteristics. However, in practice, the function of procuratorial environmental public interest litigation is not clear enough. The scope of procuratorial supervision of ecological environment and resource protection is narrow, the enforcement effect of maintaining the overall environmental public interest is not strong, and the mechanism for participating in environmental governance is not perfect.In the new era, under the leadership and promotion of the Communist Party of China, ecological priority and green development have become the main theme of social and economic development. Local governments have increasingly strengthened their environmental protection responsibilities, and gradually formed integrated ecological management concepts and models.The procuratorial environmental public interest litigation should conform to the development process of China’s environmental rule of law in the new era. Through procuratorial supervision and supervision, we will consolidate the environmental administrative responsibilities of governments at all levels, strengthen all-round supervision of the public environmental interests from the process to the results, and adhere to the organic combination of supervision and supervision and performance coordination. The realization of the procuratorial environmental public interest litigation function should be strengthened from the clear scope of acceptance of the procuratorial environmental public interest litigation, the optimization of the implementation of environmental administrative procuratorial supervision, and the synergistic interaction mechanism between procuratorial supervision and administrative power.
