摘要：《监察法》确立了集中、统一、高效的监察权监督体系,同时,《监察法》也对监察权接受监督问题做出了一系列安排。按照监察法的规定,对监察权的监督,核心是自我监督,也是一种内部政治性监督;其次是司法机关的司法制约,也是一种补充性监督,两者构成了一种涵盖事前、事中和事后的常态性监督体系,既包括纪法观念、伦理操守的监督,也包含对案件业务质量的监督。此外,民主监督和人大监督无法担当日常常态性监督重任。只有理解和把握好对监察权监督体系的立法设计,才能保障监察权合法正当地运行。
The Law has established a centralized,unified,and efficient supervisory system for supervisory power.At the same time,the Supervision Law has also made a series of arrangements for the supervision of supervisory power.According to the provisions of the Supervision Law,the core of the supervision of the supervisory power is self-supervision,which is also an internal political supervision;secondly,the judicial restriction of the judiciary,which is also a supplementary supervision.Both constitute a normal supervision system covering prior,in-process and after-event,including both the concept of discipline and ethics,and the quality of the case.In addition,the democratic supervision and the People’s Congress supervision can not bear the heavy responsibility of the daily and normal supervision.Only by understanding and grasping the legislative design of the supervision system of supervision power can we guarantee the legitimat and proper operation of supervisory power.
