摘要：从发现与证立的视角来看,法律解释活动实则具有二阶构造,即作为发现的一阶法律解释与作为证立的二阶法律解释。一阶法律解释发生在前,其以获取正当的个案规范为目标。二阶法律解释发生在后,其以证立个案规范为目标。对于法律人而言,法律解释得以展开的前提是一阶法律解释,其重心在于二阶法律解释。然而,在现实的法律解释活动中,两者并非截然分离,而是相互渗透、互相影响。由于法律解释方法为一阶法律解释框定了经验理性,法律解释的论证规则为二阶法律解释输送了逻辑理性,这就为法律解释的理性化提供了有力支持,在一定程度上缓和了法律解释的困境。
From the perspective of discovery and justification, the construction of legal interpretation actually has two levels, they are the first-order legal interpretation based on discovery and the second-order legal interpretation based on justification.The first-order legal interpretation takes place before, and its goal is to obtain the proper norms fitting for the case at hand.The second-order legal interpretation takes place after, and its goal is to justify the norms fitting for the case at hand.For lawyers, the premise of legal interpretation is the first-order legal interpretation, but its focus is the second-order legal interpretation.However, in the actual legal interpretation activities, they are not completely separated, but permeated and influenced by each other.The methods of legal interpretation select the empirical rationality for the first-order legal interpretation, and the rules for justifying the legal interpretation convey the logical rationality for the second-order legal interpretation.Thus both of them provide a strong support for the rationalization of legal interpretation and help us get out of the dilemma of legal interpretation to a certain extent.
