摘要：刑法谦抑性理念和原则在防止冤假错案、保护被告人合法权益方面发挥着不可忽视的作用。为确保刑法正确实施,需要对刑法谦抑性的涵义进行辨析,对其理论基础进行明确,并发现该原则适用中的问题,找到解决问题的途径。
The ideas and principles of modesty and restraint principle of criminal law play an important role in preventing justice miscarriages and protecting legitimate interests of the defendant. In order to make a contribution to make ensure the criminal law can be implemented in a correct way,this paper will analyze the meaning of the modesty and restraint principle of Criminal Law and make reader clear about the theoretical basis,and then find out the problems in the process of application and finally provide relative methods.
