摘要：对经营高危险性体育项目主体的界定应当适用《国家体育总局关于做好经营高危险性体育项目管理工作的通知》的规定,不应将"以营利为目的"作为条件。《经营高危险性体育项目许可管理办法》关于申请人应当提交"体育场所的所有权或使用权证明"的规定,在实质上与《全民健身条例》的规定相一致,没有超越职权。受理经营高危险性体育项目许可申请的体育主管部门在对申请材料的审查过程中,对场所、设施应进行实质审查,对场所、设施之外的申请材料应首先进行形式审查,在需要对申请材料的真实性进行审核时,再转入实质审查。
Notification of General Administration of Sport of China on Supervising High Risk Sports Programs Businesses shall be applied to defining the businesses subjects of high risk sports programs and the subjects ＇ purpose of profit should be swept aside. Administrative Permission Policy on High Risk Sports Programs Businesses requiring applicants to submit ＂ownership or use right certificates of sports locations and facilities ＂consists with National Fitness Regulation. Sports locations and facilities should be examined substantively by sports authorities. The other application materials should be examined formality first and then substantively by sports authorities if needed.
