摘要:当前,刑释人员就业还遭受着较强的制度和社会排斥,在这个意义上,其属于特殊的“弱势群体”。刑释人员就业权得不到保障的原因有多个方面,主要是监狱行刑轻视技能教育、帮教安置工作不能全覆盖、就业资格存在制度性限制、社会普遍存在歧视观念以及刑释人员个体素质存在较大差异等。据此,应当加强和完善立法、消除制度歧视的环境,实现监狱行刑环节职业技能培训和帮教安置职业技能培训相衔接,并建立和完善企业雇佣刑释人员和社会组织、志愿者参与帮教的激励机制,构建对刑释人员个体和家庭的长期心理、人格辅导机制。只有这四个层面的协调推进,方能充分保障刑释人员的就业权。
At present,the employment of released prisoners is still suffering from strong institutional and social exclusion,in this sense,they belong to a special"vulnerable group".There are many reasons why the employment right of the released prisoners cannot be guaranteed,including the neglect of skill education in prison execution,the lack of full coverage of help,education and resettlement work,the existence of institutional restrictions on employment qualifications,the widespread discrimination in society and the great difference in the individual quality of the released prisoners.Accordingly,we should strengthen and improve the system of legislation,eliminate discrimination in the environment,realize the prison execution link place for vocational skills training and education of corresponding vocational skills training,establishing and perfecting the enterprise employment rehabilitation personnel and social organizations,volunteer education incentive mechanism,build for rehabilitation personnel individual long-term psychological,personality and family counseling mechanism.Only through the coordination of these four aspects can the employment rights of released prisoners be fully guaranteed.
