摘要：作品在文献检索中的特殊性,有必要限制其著作权。我国著作权法主要通过报刊摘编转载法定许可规则处理摘要作品的使用问题,但是无法拓展至网络空间,造成文献数据库使用摘要作品的侵权风险。伯尔尼公约以及不少域外立法例将使用摘要作品规定为合理使用,我国有必要予以借鉴。我国著作权法应该将合理引用规则作为摘要作品著作权限制的主要法律依据,并化解其与报刊摘编转载法定许可规则的冲突。在著作权法第三次修改中,有必要移除合理引用规则"在作品中引用"的限制性条件,引入合理使用开放性条款,同时允许著作权人以经过认证的许可方案部分代替合理引用规则,以促进著作权人与文献服务商之间的合作。
Abstract is a special way of literature retrieval, and thus its copyright should be restricted. However, the statutory license for excerpted printing by the press, prescribed in Article 33 of the Copyright Law of the People＇s Republic of China, couldn＇t be applied in the network environment, and databases might face eopyright infringement risks because of their literature retrieval service. In contrast, the Berne Convention and many foreign laws approve the fair use of abstract. As a result, China should make an amendment to its Copyright Law, adopting the fair quotation rules for the use of abstract, and resolve the conflict between the [＇air quotation rules and the statutory license for excerpted printing by the press. In the future third amendment, it is necessary to remove the restrictive rule of ＂reference in works only＂, add some terms of fair use, and allow copyright owners to replace fair quotation rules with certified licensing scheme, so as to promote the cooperation between copyrighl owners and service providers.
