摘要:对政府有限权力、有限能力以及对规制空间内各类主体之间相互依存关系的再认识,催生了现代规制理论从行政规制到规制治理的理论变迁。规制治理理论是自我规制、反身规制、元规制、回应性规制等理论的综合体,意在表达规制改革后,其内涵、外延扩张变化的过程以及改革后的样态。该理论强调,在政府规制主体之外,应当更多利用第三方机构、被规制对象等非政府机构的能力进行自我规制和规制他人;单一的行政规制应当转向为规制者的多样性、规制规范的多样性;规制不再是一个主体简单向另一个主体施加某种要求的过程,应当采用多元规制措施替代国家单一科层控制措施;同时保障多元主体及工具下复杂法律关系中的问责机制实现等。规制治理理论不仅影响我国环境法律制度体系宏观结构调整,同时也影响单项环境法律制度的微观规范结构生成,我国环境法律制度的结构性调整应实现从行政规制到规制治理的理论转向。
The re-recognition of the government’s limited power,limited capabilities,and the interdependence of various subjects in the regulatory space has spawned a theoretical shift in modern regulatory theories from administrative regulation to regulatory governance.Regulatory governance theory is a synthesis of theories in self-regulation,reflexive regulation,meta-regulation,responsive regulation,self-regulation and others.It is intended to express the process of connotation,extension,expansion,and change after regulatory reform.The theory of regulatory governance emphasizes that in addition to the main body of government regulation,the ability of non-governmental organizations such as third-party agencies,regulated objects and others should be used to self-regulate and regulate others;single administrative regulation should be turned to a diversity of regulators and regulatory norms;regulation is no longer a process in which one subject simply imposes certain requirements on another subject,and multiple regulatory measures should be used to replace the national single bureaucratic control measures.At the same time,it guarantees the realization of accountability mechanisms in complex legal relations under multiple subjects and tools.The theory of regulatory governance not only affects the macro-structure adjustment of China’s environmental legal system,but also affects the generation of micro-standards of individual environmental legal systems.
