摘要:我国现行劳动法为自贸区劳动争议处理提供了基本的法律依据,但在对自贸区劳动关系进行法律调整时,存在境外人员就业面临障碍、适用的劳动标准与国际劳工标准不同、劳动争议解决机制效率低、现行劳动法中的集体协商制度不够健全等问题。因此,应完善境外人员就业管理的相关规定,逐步实现强制性劳动标准与自愿性劳动标准协调并用,健全现行劳动法中的集体协商制度,以提高我国劳动争议解决机制的效率。
The current labor law in our country has provided basic grounds for the settlement of labor disputes in free trade zone,yet when it comes to the legal adjustment of labor relation in the free trade zone,there are still the problems of obstacles for the employment of overseas labors,difference between the applied labor standards and the international labor standards,inefficiency of labor disputes settlement mechanism,and unsound collective consultation system.Therefore,we should improve the regulations concerning the management of the employment of overseas labors,gradually realize the collaborative combination of compulsory labor standards and voluntary labor standards,improve the collective consultation system in our current labor law so as to enhance the efficiency of the labor disputes settlement mechanism in our country.
