摘要：《刑法修正案(九)》第四条以立法的形式确定了不同刑种的有期徒刑和拘役的并罚规则,然立法的表达并未对素有争议的异种有期自由刑并罚的方式起到定纷之效。通过对吸收说的检视以及对折算说的考量和品鉴,有期徒刑和拘役的并罚方式仍应以折算说为妥。
Amendment Ninth of Criminal Law,in legislative form,determines the principle of concurrent punishment of fix-term imprisonment and detention. However,legislation＇s expression has less effects on co-fine method of heterogeneous free punishment with period. By considering and examining on theory of absorption and theory of conversion,it is better that co-fine method of fix-term imprisonment and detention should be based on theory of conversion.
