摘要：刑法中有概念也有类型。类型也是从事物的共同特征中总结出来的,它比概念更加具体、直观。类型思维是一种类似性思考,它以事物本质为主线把握案件事实的类型轮廓,并与刑法中相关规范类型进行比对,去探寻与事实相匹配的、具有相同刑法意义的规范类型,使规范与案件事实恰当对接。在概念思维无法对刑事疑难案件进行归类时,类型思维是解决这个问题的有效方法。类型化的标准包括案件事实的根本特征与刑法规范中某一罪名典型特征是否一致;案件事实的价值评价与某一刑法规范价值评价的是否一致。
There are concepts and types in the criminal law. Type is also summed up from the common features of things, and it is much more specific than concept. Thinking mode of genre is a kind of similarity thought, which divide the ease type through the essence of things, and seek the criminal law standard type with the same meaning, make the appropriate docking. When criminal hard case couldn＇t classified by conceptual thinking, type thinking is an effective method to solve this problem. Typological standards including ： whether consistent both the fundamental features of the case and the crime type in criminal law; The case facts, whether consistent both the value evaluation of the case and the crime type in criminal law.
