摘要：民国判例的法律功能,以刑事特别法为研究对象可归结为界定概念内涵、解释法条含义、区分特别法之间的选择适用、区分特别法与法典的选择适用、指示特别法与法典配合适用等类型。从实际案例分析来看,判例对准确适用法律很有必要。民国判例延续中华法系判例传统并具有自身特点,因此,民国判例对构建当代判例制度仍有借鉴意义。
The functions of precedents on the period of the Republic of China, with special criminal law as the object of study, can be attributed to defining concept, interpreting law, distinguishing special law, distinguishing special law and the code, directing special law application with the code. From analyses of actual cases, the precedents are necessary to applying the laws accurately. Precedents on the period of the Republic of China continue the Chinese legal system traditional. We can draw lessons from precedents on the period of the Republic of China on the construction of contemporary precedent system.
