摘要：从实证主义与规范主义的角度出发,在分析70件样本案例之后发现,村规民约中计划生育条规纠纷影响着村民福利待遇、土地补偿款分配以及集体经济组织成员资格等权益。而法院对该类纠纷处理上可分为四种模式,即民事诉讼的不予审查模式、以及直接审查模式(包括集体利益本位模式和个人权利本位模式)行政诉讼的间接审查模式。四种法院模式体现了形式正义和实质正义、集体利益本位和个人利益本位的法律价值取向。本文认为,按照实质法治的要求,村规民约中计划生育条款纠纷不属于村民自治的范围,而是属于政务的范围,应当适用行政诉讼对其进行直接审查。
from the perspectives of positivism and prescriptivism,this paper analyzes 70 sample cases and finds that the disputes over family planning regulations in village regulations affect villagers’welfare benefits,land compensation distribution and collective economic organization membership.In handling such disputes,the courts can use four modes,namely,the non-examination mode of civil litigation,the direct examination mode(including the collective interest-based mode and the individual rights-based mode)and the indirect examination mode of administrative litigation.The four court models embody the legal value orientation of formal justice and substantive justice,collective interest-based and individual interest-based.This article holds that,in accordance with the requirements of the substantive rule of law,disputes over family planning clauses in village regulations and civil agreements do not belong to the scope of villagers’autonomy,but belong to the scope of government affairs,and administrative litigation should be applied to directly review them.
