摘要:生态用地规划机制的缺失是导致相当数量的生态用地转为建设用地的重要因素,危及国家生态安全。生态用地规划机制的建构要求从伦理上树立绿色发展观,从理性上确立生态用地类别,从规制上实现生态规划法治化,分别建构与完善生态用地保护制度、生态用地用途管制制度、生态规划环评制度、集约节约用地制度,从责任上实行规划权责法定化,分别从规划内容及规划程序上倒查相关主体的生态规划责任。
The lack of ecological land planning mechanism is an important factor that is tuninglarge piece of ecological land into construction land,which has endangered the national ecological security. The construction of ecological land planning mechanism requires us to establish a green development concept from the ethic,to develop the ecological land category based on ration,and to achieve the legalization of ecological planning in terms of regulation. It also requires us to construct and improve the ecological land protection and control system,the ecological planning EIA system as well as the intensive and commercial land system,to implement the legalization of planning authority based on the responsibility,and to respectively carry out reversed investigation on the relevant ecological responsibility of the main body from the planning contents and planning procedures.
