摘要：“新冠疫情”的爆发,给法院的开庭审判和当事人参与诉讼提出了新的要求和挑战,为了阻断疫情传播途径,降低感染风险,多地法院采取了网上开庭的形式审理案件。这也给法院审查当事人身份增加了难度和工作量。通过具体的案例引出网上开庭必须强化对当事人主体身份的审查,重视民事授权行为在诉讼领域的生效条件,以防止因当事人不适格错判案件,浪费司法资源,徒增当事人讼累。进而提出重视对跨领域法律的精确性理解运用,强化司法审判的防火墙作用与规范引导作用。
The outbreak of“COVID-19”has brought new demands and challenges to the court trial and the participation of litigants in litigation.In order to block the transmission way of the epidemic and reduce the risk of infection,most courts have tried the case online.This also increases the difficulty and workload for the court to examine the identity of the parties.Through specific cases,the author points out that the online court must strengthen the examination of the identity of the parties,and pay attention to the effective conditions of civil authorization in the field of litigation,so as to prevent the improper judgment of cases due to the parties’disqualification,waste of judicial resources and increase the litigation burden of the parties.Then,it puts forward that we should pay attention to the accurate understanding and application of cross field law,and strengthen the firewall role and normative guidance role of judicial trial.
