摘要：推行认罪认罚从宽必将对我国量刑制度乃至定罪制度产生深远的影响。在当前案多人少、司法资源紧张、司法效率亟需提高的背景下,这一改革具有正当性和紧迫性。贯彻宽严相济司法政策与推行认罪认罚从宽制度,这两者是什么样的关系,值得思考。它们之间的关系不理顺,就容易造成凌驾于宽严相济之上的只宽不严的后果。因此,推行认罪认罚从宽制度仍应从理念、操作层面、审判环节、执行环节等方面严格贯彻宽严相济的刑事政策,并进一步厘清与既有从宽制度的关系,以实现改革效果的最大化。
It is to carry out the leniency system of plead guilty and accept punishment will have a profound influence on sentencing system and conviction system in our country. Under the background of the court case many people less,judicial resources are reserved,judicial efficiency should be improved urgently,this reform is justified and pressing. The implementation of the criminal policy of temper justice with mercy and carry out the leniency system of plead guilty and accept punishment,what is the relationship between the two,which is why it is worth thinking about. If this relationship of them has not yet been straightened out,it will cause the consequence of the temper justice with mercy is subordinate to the leniency.Therefore,it is to carry out the leniency system of confession and punishment,we still should strictly implement the criminal policy of temper justice with mercy from the concept,the operation level,the trial sessions,the execution process and so on,and further clarify the relationship with the existing leniency system,in order to maximize the reform effect.
