摘要：物业服务属于朝阳、绿色产业。当前我国物业服务领域存在的诸多问题,其原因主要是相关法律制度缺失。现行立法对物业服务的主体、物业服务合同的缔结与履行、物业服务的监管及相关纠纷处理等,都没有科学的制度设计。完善我国物业服务法律制度,需要赋予业主委员会完全的诉讼主体资格,建立健全住宅专项维修资金制度、物业服务合同解除制度、物业服务监管制度、物业服务纠纷人民调解制度等。
Property service industry is prospective and green. At present,there are many problems in the field of property service in China,the main reason lies in the deviation and lack of relevant legal system. The current legislation doesn＇ t cover the subjects,contracts,regulations and dispute solving totally. To enrich the institutions of property service,our country should grant the the proprietors＇ committee full subject qualification of litigation,establish the market-orientated property management fees rules,enrich the special maintenance fund rules and dissolution of property service contracts,property service regulations rules and etc. Besides,the people＇s mediation institution should be established.
